Welcome to our platform. These Terms of Use govern your access to and use of our Website and Web Store (referenced as WaterWay Fins). This website is operated by WaterWay Fins.


1. General Eligibility & Use

  • Age Requirement: Use of the Web Store is restricted to individuals 18 years of age or older.
  • Payment Authority: You must hold a valid credit/debit card (Visa, MasterCard, American Express) or a verified PayPal account.
  • Usage Scope: The Web Store serves personal, retail, and wholesale customers worldwide.
  • Agreement: Placement of an order constitutes a legal declaration of agreement to these terms.

2. Purchase Protocol & Payments

Ordering Process

All purchases must be executed directly through the Website. You are required to provide accurate personal information. Submission of false data is a felony. The Store Owner reserves the right to cancel orders and pursue criminal or civil prosecution for fraudulent submissions.

Pricing & Currency

  • Availability: Products and services are subject to change without notice. If an item is unavailable, we will offer an alternative or a full refund.
  • Currency Conversion: Payments may be debited in a currency different from your checkout preference; your bank may apply additional conversion fees.
  • Ownership: All goods remains the property of the Web Store until payment is cleared in full.

Technical Failures

The Store Management is not liable for purchase failures caused by third-party technical issues (power surges, ISP outages, or user hardware failure). You will only be charged for orders where the process was fully completed.


3. Shipping, Global Logistics & GEO-Specifics

EU & International Shipping

  • EU Orders: Shipped from our Slovenian warehouse. These are not subject to EU import duties.
  • International Orders: For customers outside the European Union, local taxes and customs duties may apply. These are the sole responsibility of the Customer.
  • Delivery Method: Primary shipping is via Slovenia Post Airmail (with tracking).

Custom Fabrication Timelines

Most of our professional-grade equipment is handcrafted to order:

  • Standard Orders: Processed in 2–3 business days.
  • Fins/WaterWay/UltraFins: Processing may take up to 21–60 business days depending on production load.
  • Delivery: Can take up to an additional 28 business days post-processing.

Customer Responsibility

It is your responsibility to track the parcel and collect it from the local post office. If an item is returned due to "Failed Delivery" or "Incorrect Address", the Customer is responsible for return and re-shipping fees. No refunds will be issued for failed collections.


4. Product Specifications & Customization

Color & Material Variations

Due to global supply chain shifts (including rubber sourced from various regions), specific color matches cannot always be guaranteed. If your chosen color is unavailable, we will provide the closest match. Reclamations based on color variation are not accepted.

Professional Sizing (Monofins & Fins)

Our products are designed for professional athletes and feature a "tight fit". Foot pockets are manufactured slightly smaller (1–1.5cm less) than the provided foot size to ensure performance. If you require exact sizing without the professional adjustment, you must notify us via email within 24 hours of placing your order.


5. Warranty & Liability

12-Month Limited Warranty

Coverage begins upon receipt and covers manufacturing defects. Coverage is void if the product is exposed to temperatures above 40°C or below -5°C, direct sunlight for extended periods, chemicals, or unauthorized modifications. Exclusions include normal wear, overstretching rubber, overbending carbon fiber, or damage from improper swimming techniques.

Claims Process

  1. Inspection: Inspect your package immediately upon delivery. If damaged, the postal worker must sign a damage report.
  2. Notification: Email orders@waterwayfins.eu within 7 days for defects or 14 days for returns.
  3. Photos: Clear photos of the item AND the original shipping label are required.

6. Security, Privacy & Marketing Data

Data Processing & Third Parties

Visitor details are stored securely in accordance with the Data Protection Act. By using this website, you acknowledge and consent that we transfer specific data to Mailchimp, Google, and Meta services for the purposes of email communication, advertisement setup, and performance tracking. We take all reasonable measures to ensure your data remains secure during these transfers.

Force Majeure

Neither party is liable for delays caused by Acts of God, including natural disasters, pandemics, war, strikes, or government embargoes. If a Force Majeure event exceeds 120 days, either party may terminate the agreement.


7. Returns & Cancellations

  • 24-Hour Window: Cancellations and full refunds are only possible within 24 hours of order placement, provided the item hasn't entered production.
  • No Trial Period: Products are not sold on a trial basis.
  • Return Costs: The customer is responsible for all shipping and insurance costs for returned items. Items must be marked "Returned for Repair" to avoid unnecessary customs fees.
